Terms and Conditions
By using McFile GmbH’s products, software, services, or website, you agree to the Terms and Conditions set forth below. These Terms and Conditions cover all products, software, and services offered, now or in the future, by McFile GmbH, referred to below, individually and collectively, as “Services.”
These “Services” are offered exclusively to individuals over 18 years of age, or minors emancipated by law. Each user is solely and personally responsible for all content stored or shared through the “Services” and for all related consequences. As a condition of using the “Services,” you agree not to use them for any illegal or legally prohibited activity. You also agree to and adhere to all Terms and Conditions set forth herein.
User registration information and personal identification data are subject to McFile GmbH’s Privacy Policy, which is subject to change and is currently located at https://mcfile.com.br/politica-de-privacidade/. By using the “Services,” you agree to comply with all applicable national and international laws and regulations regarding the aforementioned “Services” and not to use McFile GmbH for illegal purposes.
You agree to immediately notify McFile GmbH if you observe any unauthorized use of your password or account or any other breach of security.
Responsibility
McFile GmbH is constantly improving its “Services,” which is why they may occasionally contain errors. McFile GmbH may make changes to its “Services” at any time and without prior notice to its users. As with any service, McFile GmbH guarantees the reliability of its “Services,” but does not guarantee the security of its users’ data. Despite McFile GmbH’s best efforts, no service is 100% reliable and secure.
You are aware and expressly agree that:
- Your use of the “Services” is at your own risk. The “Services” are provided “as is” and “as available.” To the fullest extent permitted by law, McFile GmbH expressly disclaims all warranties, guarantees, and conditions of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- McFile GmbH does not warrant that: (i) the “Services” will meet your requirements; (ii) the “Services” will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the “Services” will be accurate or reliable; and, (iv) any errors in the software will be corrected;
- Any material downloaded or otherwise obtained through the “Services” is obtained at your own discretion and risk, and that you will be solely responsible for any damage to your computer system or any other device, or loss of data that occurs as a result of the download of any such material;
- McFile GmbH will not be responsible for any confidential material that is accidentally released as a result of a security breach;
- The “Services” contracted herein do not include, in any way, Internet access. Therefore, it is the User’s sole and exclusive responsibility to obtain, independently and at their own expense, the equipment, software, and services necessary to ensure their connection to the Internet and to the McFile website that provides access to the “Services.”
Intellectual Property and License Rights
The “Services” and any software used in connection with these “Services” contain proprietary and confidential information that is protected by intellectual property rights and other applicable laws. McFile GmbH grants you a limited, personal, non-transferable, and non-exclusive license to use the McFile software or its utilities and related documentation, to the extent they may be provided by the “Services.” You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, reverse engineer, create derivative works, build a product using similar ideas, functions, or graphics, transfer, or sell any information, software, products, or services.
Indemnity
You agree that McFile GmbH, its parent companies, subsidiaries, directors, and agents shall not be liable for any third-party claims arising from your use of the McFile GmbH “Services,” your violation of the Terms, or any actions related to your use of the McFile GmbH services, including any liability or expense arising from claims, losses, damages (direct and consequential), lawsuits, judgments, legal costs, and attorneys’ fees of any kind and nature. In such an event, McFile GmbH will notify you in writing of the claim, lawsuit, or proceeding.
Termination of use
Upon termination of any “Services,” the user agrees that, should they require assisted removal of their information, there will be costs that vary depending on the complexity of the removal and the time involved.
Modification of the Terms and Conditions of the “Services”
McFile GmbH reserves the right to review and modify this agreement at any time, and you are responsible for regularly reviewing the then-current Terms and Conditions. Continued use of the “Services” after such modifications constitutes your implicit consent to all new Terms and Conditions. These Terms and Conditions were created on April 20, 2015.
Applicable Law
This Agreement shall be governed, in all its terms and conditions, by the law in force in the Canton of Zug, Swiss Confederation. All actions brought under this Agreement must be instituted in Zug, Swiss Confederation.
