Privacy Policy
In this Privacy Policy, McFile refers to the services offered by McFile GmbH through its cloud platform and its website at www.mcfile.com.br, www.mcfile.com and www.mcfile.ch.
By using the McFile platform and the services offered by McFile GmbH, you consent to the use of your information as described in this Privacy Policy.
Laws and Regulations
McFile GmbH is headquartered in Switzerland and operates under the laws and regulations of the Swiss Confederation, in particular under the Swiss Federal Data Protection Act (DPA).
McFile GmbH complies with the new data privacy regulation requirements of the European Union, GDPR (Regulation EU 2016/679).
According to the Swiss Federal Act on the Surveillance of Postal and Telecommunications Traffic (SPTT), McFile GmbH is not obliged to promote technical means to intercept communications from its customers, even if this is possible.
Data Policy
Any data provided to McFile GmbH through our cloud platform or website is considered privileged information. Your data will never be sold or shared with third parties.
All personal data processing is carried out in accordance with European Union privacy rights and regulations (GDPR). Under the GDPR, European Union citizens and residents have the following rights:
- Right to access your personal data;
- Right to correct the personal data we hold about you;
- Right to request the deletion of your personal data;
- Right to suspend the processing of your personal data;
- Right to transfer your personal data to you or to third parties;
- Withdraw consent to the processing of your Personal Data.

Data Collection
Our prevailing policy is to collect as little information as possible from the user, in order to guarantee greater privacy and anonymity when using our services.
McFile’s user data collection is limited to the following activities:
7. Account creation: Required registration data such as name, email, telephone number and company name;
8. Account activity: Date and time of access, IP address and device used, as well as records of system operations such as queries, registrations and edits are stored in internal logs;
9. Communicating with McFile: Your communications with sales and support requests, bug reports, or feature requests will be saved by our team. Our helpdesk operates through the Helpscout and Olark tools. As a result, both companies can also access the call history;
10. Quote requests and similar: we store the information filled out and provided in the forms on our websites by the user in Moskit CRM, which may also have access to your data;
11. Sending informative emails: We send email communications to customers and those interested in our services through the MailChimp platform (The Rocket Science Group LLC), where we store the email address, name, and phone number, if provided by the user. MailChimp may have access to your data, which can be deleted by unsubscribing from our list;
12. Browsing our website: Number of visits, pages accessed, regional location of access, time spent, among other information stored by the Google Analytics tool (Alphabet Inc.), all devoid of any means that can identify its owner;
13. Blogs and Idea Bank: social tools for communication with our customers and partners, as well as our idea bank, are public and operated by third parties;
14. Credit card payment transactions are processed by third parties (Stripe platform) and McFile does not retain any customer payment information.
Data usage
McFile does not display any advertising on its website. All data we hold will never be shared with third parties, except in the circumstances described below under “Data Disclosure.” Your data may be used internally by McFile GmbH to analyze and improve our services, and will be stripped of any personal information that might identify the owner.
Your email address will only be used to contact you with news and updates about McFile, to send you notifications regarding system operations, and to conduct satisfaction surveys about our services.
Data Storage
The services provided by McFile are provided through the AWS Cloud platform of Amazon Web Services, Inc. The AWS Cloud has numerous security and compliance certificates such as ISO 9001, ISO 27001, and ISO 27018. The servers are owned and operated by Amazon in various regions around the world.
The services provided by McFile and consequent data storage occur in the following AWS Cloud regions:
15. South America Region (São Paulo);
16. Europe Region (Ireland);
17. Eastern US Region (Northern Virginia).
Data storage on servers in the Eastern US or Europe may be restricted based on each McFile client’s compliance or privacy policy. To request data storage restrictions in specific regions, please contact us.
All of our customers’ information stored in the AWS Cloud is encrypted, with access limited by Amazon, and is only released upon a valid and legal order from a government or regulatory body.
Data Retention
Accounts that have been inactive for more than three months may, at our discretion, be subject to automatic deletion. Active accounts will have their data retained indefinitely.
Data Disclosure
McFile will only disclose the data of any of our users if we receive a court order or an enforcement order from any Cantonal Court of Zug or the Swiss Federal Supreme Court.
Modification of the Privacy Policy
McFile GmbH reserves the right to review and amend this Policy at any time, and you are responsible for regularly reviewing the current Privacy Policy. Continued use of the services after such changes constitutes your implicit consent to the new Privacy Policy terms.
This Privacy Policy was created on April 20, 2015 and was last modified on July 31, 2018.
Applicable Law
This Agreement is governed, in all its terms and conditions, by the law in force in the Canton of Zug, Swiss Confederation. All actions brought under this Policy must be instituted in Zug, Swiss Confederation.
