In this Privacy Policy, “McFile” refers to the services provided by McFile GmbH through its cloud platform and its website at https://mcfile.com.
By using the McFile platform and the services provided by McFile GmbH, you consent to the use of your information as described in this Privacy Policy.
2. Laws and Regulations
McFile GmbH is headquartered in Switzerland and operates under the laws and regulations of the Swiss Confederation, particularly the Swiss Federal Data Protection Act (DPA).
McFile GmbH complies with the European Union’s data protection regulation, GDPR (EU Regulation 2016/679).
According to the Swiss Federal Act on the Surveillance of Postal and Telecommunications Traffic (SPTT), McFile GmbH is not required to implement technical means to intercept communications of its users, even if technically possible.

Any data provided to McFile GmbH through our cloud platform or website is considered confidential. Your data will never be sold, and data may be shared with third parties only when necessary to operate the services, with appropriate safeguards in place.

4. Data Collection
Our guiding principle is to collect the minimum amount of user data necessary, in order to ensure greater privacy and anonymity when using our services.
User data collection is limited to the following activities:
- Account creation: personal data such as name, email, phone number, and company name
- Account activity: access date and time, IP address, device information, and system operation logs (such as searches, registrations, and edits)
- Communication with McFile: communications with sales, support requests, error reports, and feature requests are stored by our team
- Quotes and similar requests: information submitted through forms on our website
- Email communications: we send emails to customers and interested users about our services
- Website navigation: number of visits, pages accessed, approximate location, time spent, and other analytics data collected via Google Analytics (Alphabet Inc.), without directly identifying the user
- Suggestion system and contact forms: when users submit suggestions, comments, or requests, we store voluntarily provided data such as name, email, and message content
- Payment transactions: credit card transactions are processed by third parties (Stripe platform), and McFile does not store any payment information
5. Use of Data
McFile does not display advertisements on its website. Data may be shared with third parties only when necessary to operate the services or when required by law, as described in this Privacy Policy.
Data may be used internally by McFile GmbH for analysis and improvement of services, after being anonymized or stripped of personally identifiable information.
Your email address will be used only to provide updates and news about McFile, send system-related notifications and conduct customer satisfaction surveys.
6. Data Storage
McFile services are hosted on AWS Cloud (Amazon Web Services, Inc.), which holds several security and compliance certifications such as ISO 9001, ISO 27001, and ISO 27018. Servers are operated by Amazon in multiple regions worldwide.
Data storage may be restricted according to each client’s compliance or privacy requirements. To request regional data storage restrictions, please contact us.
All customer data stored in AWS is encrypted. Access is restricted and may only be granted upon valid and legal requests from governmental or regulatory authorities.
7. Data Retention
Accounts that remain inactive for more than three months may, at our discretion, be subject to automatic deletion.
Active accounts will have their data retained for an indefinite period.
8. Data Disclosure
McFile will only disclose user data if required by a judicial order or enforceable legal request issued by a Cantonal Court of Zug or the Swiss Federal Supreme Court.
9. Changes to this Privacy Policy
McFile GmbH reserves the right to review and update this Privacy Policy at any time. Users are responsible for periodically reviewing the current version.
Continued use of the services after any changes constitutes acceptance of the updated terms.

10. Applicable Law
This Agreement is governed by the laws of the Canton of Zug, Swiss Confederation.
Any disputes arising from this Privacy Policy shall be brought before the courts of Zug, Switzerland.
